We provide professional creative and artistic services, including but not limited to the following:1. Artwork Creation, Sale, and Delivery:
The design, creation, and sale of original artworks, limited edition prints, and taxidermy specimens. Each piece is produced in accordance with our quality standards and, where applicable, complies with all relevant laws and ethical sourcing requirements.2. Commissioned Works:
The creation of custom artworks or taxidermy pieces tailored to the client’s specifications, subject to mutual written agreement. Such agreements will outline the scope of work, materials, timeline, pricing, and any other relevant terms. Once a commission has commenced, changes to the agreed-upon specifications may result in additional fees or adjusted delivery timelines.3. Consultation and Curation Services:
Professional advice and assistance relating to the display, installation, preservation, or curation of artworks and collections. These services may include recommendations on framing, placement, environmental conditions, or collection management practices. Consultation services are provided for informational purposes only and do not constitute legal, tax, or valuation advice unless expressly stated otherwise.4. Service Terms and Pricing:
All services are rendered in accordance with the terms, scope, and pricing agreed upon with the client prior to commencement. Written confirmation, invoice, or contract outlining the agreed terms constitutes acceptance of the specific service arrangement. Any additional work or modification requested by the client outside the original agreement will be subject to a separate quotation or amendment.5. Limitations and Availability:
We reserve the right to decline, modify, or discontinue any service at our sole discretion, including but not limited to instances where a project is deemed impractical, unethical, or in violation of applicable regulations. Completion timelines are provided in good faith but may vary due to factors beyond our control, including supply delays or material availability.
By accessing or using our services, platforms, or content, all clients and users agree to conduct themselves in a manner that is respectful, lawful, and consistent with the standards of professionalism expected by our organization.Users are expected to:1. Respect Others:
Treat all members of our team, including our staff, artists, collaborators, and other clients, with courtesy, professionalism, and respect. Harassment, discrimination, defamation, or any form of abusive or inappropriate behavior will not be tolerated.2. Lawful and Ethical Use:
Engage with our content, services, and platforms only for lawful purposes and in accordance with applicable laws and regulations. Users must not engage in any activity that may infringe upon the rights, privacy, or intellectual property of others.3. Prohibited Conduct:
Users must refrain from any conduct that, in our sole discretion, is deemed to be:- Abusive, threatening, harassing, defamatory, or otherwise harmful to others;
- Fraudulent, deceptive, or misleading;
- Disruptive to the normal operation of our services or detrimental to the experience of other users;
- Intended to interfere with, damage, or gain unauthorized access to our systems, networks, or data; or
- In violation of any applicable law, regulation, or contractual obligation.4. Enforcement and Remedies:
We reserve the right, at our sole discretion, to investigate any reported violations of these Terms and to take appropriate action, which may include issuing warnings, suspending or terminating access to our services, or pursuing legal remedies where necessary. We may do so without prior notice if such action is deemed necessary to protect our team, clients, or business interests.
1. Ownership of Intellectual Property
All artworks, taxidermy pieces, designs, photographs, written materials, digital content, and any related creative works (collectively, the “Works”) produced, created, or otherwise provided by Season’s Cove remain the sole and exclusive intellectual property of Season’s Cove, unless otherwise expressly transferred by written agreement signed by both parties. This ownership includes, without limitation, all copyrights, design rights, moral rights, and any other intellectual property or proprietary rights subsisting in the Works, whether registered or unregistered.2. Client Usage Rights
Upon full payment, clients are granted a limited, non-exclusive, non-transferable license to use and display the purchased Work(s) solely for personal, non-commercial purposes, subject to the terms and conditions outlined herein. This license does not confer any right of ownership, reproduction, modification, distribution, or commercial exploitation.2(a). Physical Works: Clients may display purchased physical artworks or taxidermy pieces within personal or private spaces but may not reproduce, digitalize, or publicly exhibit them for commercial gain without written authorization.2(b). Digital Works or Photographs: Where digital files are provided, clients may retain and display them for personal use only. Any sharing, reproduction, or publication beyond personal use requires prior written consent from Season’s Cove.3. Prohibited Uses
Unless explicitly authorized in writing by Season’s Cove, clients and third parties are strictly prohibited from:- Reproducing, copying, scanning, photographing, or otherwise duplicating the Work(s) in any form;
- Creating derivative works or modifications;
- Selling, licensing, or distributing the Work(s) or any reproductions thereof;
- Using the Work(s) for advertising, branding, or promotional purposes; or
- Displaying the Work(s) in public exhibitions, online galleries, or media outlets for profit or publicity.4. Requests for Commercial Licensing
Clients seeking to reproduce or commercially use any Work(s) must obtain prior written consent and may be subject to additional licensing fees, royalties, or contractual terms as determined by Season’s Cove. All such agreements must be executed in writing before any commercial use begins.5. Moral Rights and Attribution
Season’s Cove retains the right to be credited as the creator of the Work(s) and to object to any distortion, mutilation, or modification that may harm the integrity or reputation of the artist or the business. Clients agree to provide appropriate attribution where the Work(s) are lawfully displayed or referenced publicly, unless otherwise agreed in writing.6. Enforcement
Any unauthorized use, reproduction, or distribution of the Work(s) constitutes a violation of intellectual property law and may result in civil or criminal liability. Season’s Cove reserves the right to pursue all available legal remedies to protect its rights and interests.
1. General Limitation
To the fullest extent permitted by applicable law, Season’s Cove, including its owners, employees, artists, contractors, and affiliates, shall not be held liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, loss of data, business interruption, or emotional distress, arising out of or in connection with the purchase, possession, use, or display of any artwork, taxidermy specimen, design, or related service provided by Season’s Cove, even if advised of the possibility of such damages.2. Expectation and Representation
While Season’s Cove strives to ensure accuracy in the description, representation, and delivery of all artworks and taxidermy pieces, no guarantee, warranty, or representation is made that any item will conform precisely to a client’s personal expectations beyond the details explicitly agreed upon in writing prior to purchase or commission. Variations in materials, coloration, or natural characteristics inherent to artistic or taxidermy processes shall not constitute a defect or failure of performance.3. Condition, Handling, and Care
Upon delivery or collection, ownership and risk associated with the artwork or taxidermy piece transfer to the client. Clients are solely responsible for the safe handling, installation, environmental conditions, and ongoing care of purchased pieces. Season’s Cove assumes no liability for damage, deterioration, or loss resulting from improper handling, storage, exposure to environmental factors, pest activity, or failure to follow care instructions provided at or before delivery.4. Display and Environmental Risks
Clients acknowledge that artworks and taxidermy specimens are sensitive to temperature, humidity, light, and other environmental conditions. Season’s Cove is not responsible for any degradation, discoloration, distortion, or other changes that occur over time due to natural aging processes or environmental exposure after the item has been delivered.5. Third-Party Services and Installations
Season’s Cove accepts no liability for damage or loss caused by third-party services, including framing, mounting, transport, installation, or restoration performed by individuals or entities not directly authorized by Season’s Cove. Clients engaging third parties do so at their own risk and expense.6. Maximum Liability
In any event, and regardless of the cause of action, the total liability of Season’s Cove for any claim, loss, or damage arising under or in connection with these Terms or the sale or display of any Work shall not exceed the total amount paid by the client for the specific Work or service giving rise to the claim.
No Warranty
1. As-Is Condition
All artworks, taxidermy pieces, designs, and related items produced or sold by Season’s Cove are provided “as is” and “as available”, without any express or implied warranties of any kind, unless otherwise explicitly stated in a written agreement signed by both parties.2. No Implied Warranties
To the fullest extent permitted by law, Season’s Cove expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, durability, accuracy, or non-infringement. No advice, information, or representation, whether oral or written, obtained from Season’s Cove or through our services, shall create any warranty not expressly stated herein.3. Natural and Artistic Variations
Clients acknowledge and accept that variations in texture, color, pattern, and form are inherent to the creative and natural materials used in artworks and taxidermy specimens. Such variations are characteristic of handcrafted and natural pieces and shall not be considered defects, flaws, or grounds for replacement, refund, or warranty claim.4. Environmental and Material Considerations
Artworks and taxidermy specimens are subject to changes over time due to natural aging processes and environmental factors such as temperature, humidity, light exposure, and handling conditions. Season’s Cove does not warrant the longevity or preservation of materials beyond the reasonable life expectancy of such items under proper care and display.5. Third-Party Components and Materials
Where third-party materials, fixtures, or display components are incorporated into a piece, any warranties related to those materials are limited to those provided directly by the third-party manufacturer or supplier, if applicable. Season’s Cove makes no independent warranties or guarantees regarding such third-party components.6. No Guarantee of Investment Value
Season’s Cove does not represent or warrant that any artwork, mineral, taxidermy specimen, or design will increase in value, retain its value, or serve as a financial investment. The purchase of our works should be understood as a personal and aesthetic acquisition, not a speculative or commercial transaction.
1. Artistic and Natural Variations
While Season’s Cove takes the utmost care in the creation, presentation, and documentation of all artworks, taxidermy pieces, and related items, clients acknowledge and accept that each piece is unique. Variations in color, texture, size, finish, composition, and form are inherent to handcrafted and natural works and may differ slightly from photographs, samples, or descriptions provided online or in promotional materials. Such variations shall not be deemed defects, inaccuracies, or grounds for return, refund, or replacement.2. Representation and Accuracy
All photographs, digital representations, and written descriptions of our works are provided for illustrative purposes only. While every effort is made to depict items accurately, Season’s Cove cannot guarantee that displayed colors or appearances on screens or printed materials will precisely match the final physical product. Environmental factors, lighting conditions, and display settings may affect perceived appearance.3. Live Specimens and Natural Materials
Where applicable, Season’s Cove may provide or prepare works involving live, preserved, or natural specimens. All such specimens are sourced and handled in accordance with applicable ethical standards, legal regulations, and industry best practices. Clients purchasing live specimens will receive detailed care and maintenance instructions; however, Season’s Cove cannot guarantee the continued health, survival, or condition of any live specimen beyond the point of delivery and reasonable acclimation, as these factors depend on environmental conditions and client care beyond our control.4. Environmental Sensitivity
Artworks, taxidermy pieces, and biological materials are sensitive to temperature, humidity, light exposure, and handling. Season’s Cove disclaims any responsibility for damage, fading, deterioration, or change in condition resulting from environmental exposure, improper handling, or failure to adhere to provided care guidelines.5. Compliance and Ethical Practices
Season’s Cove adheres to all applicable laws and ethical standards regarding the sourcing, preparation, and sale of natural or taxidermy materials, including relevant conservation and wildlife regulations. However, it remains the client’s responsibility to ensure compliance with local or international import, export, and possession laws that may apply to the receipt or display of such materials within their jurisdiction.
1. Good Faith Negotiation
In the event of any disagreement, claim, or dispute arising out of or in connection with these Terms, any related agreements, or the services or works provided by Season’s Cove (collectively, a “Dispute”), both parties agree to first make reasonable and good faith efforts to resolve the matter amicably through direct negotiation. Each party shall provide written notice of the nature of the dispute to the other party and allow a reasonable period, not less than thirty (30) calendar days, for informal resolution discussions.2. Mediation (Optional Pre-Litigation Step)
If the parties are unable to reach an amicable resolution through negotiation, they may mutually agree to submit the dispute to mediation before a neutral mediator located in Belgium. The mediation shall be conducted in the English or Dutch language, depending on the preference of the parties, and in accordance with the mediation rules or procedures agreed upon at the time. The costs of mediation shall be shared equally unless otherwise agreed in writing.3. Jurisdiction and Applicable Law
Should the dispute remain unresolved after negotiation (and mediation, if applicable), either party may submit the matter to the competent courts of Belgium, which shall have exclusive jurisdiction over any dispute, controversy, or claim arising from or relating to these Terms, the sale of goods or services, or any related contractual or non-contractual obligations.4. Consumer Rights Exception
Nothing in this clause shall limit or exclude any rights that clients who qualify as consumers under applicable Belgian or EU law may have to bring claims in their own country of residence or to rely on mandatory consumer protection laws that apply in their jurisdiction.5. Language of Proceedings
Unless otherwise required by law, any dispute or legal proceeding shall be conducted in the English or Dutch language, as determined by Season’s Cove, to ensure clarity and consistency in legal interpretation.
1. General Payment Obligations
Clients agree to pay all fees and charges associated with the purchase or commission of artworks, minerals, taxidermy pieces, or related services in accordance with the pricing, payment schedule, and terms specified in the relevant invoice, quotation, or written agreement issued by Season’s Cove. All prices are stated in euros (EUR), unless otherwise indicated, and are exclusive of any applicable taxes, duties, or transaction fees, which shall be borne by the client.2. Accepted Payment Methods
Season’s Cove accepts payment via PayPal, bank transfer, major credit or debit card, and cash, unless otherwise agreed in writing. Clients are responsible for ensuring that all payment information provided is accurate and that sufficient funds are available to complete the transaction. Any fees or currency conversion charges imposed by the client’s financial institution or payment provider remain the sole responsibility of the client.3. Payment Schedule for Commissions
For commissioned works or custom projects, a non-refundable deposit of 80% may be required to secure the order and initiate the creative process. The remaining balance shall be due upon completion of the work and prior to delivery or collection, unless otherwise specified in writing. Work on a commission will not commence until the deposit has been received and cleared. Otherwise, Season's Cove demands payment in full prior to the commission's completion.4. Ownership and Title Transfer
Legal ownership, title, and any associated rights to the artwork, taxidermy piece, or commissioned work shall not transfer to the client until full and final payment of all amounts due has been received and cleared by Season’s Cove. Until such payment is made, all works remain the sole property of Season’s Cove, and the business reserves the right to retain, withhold delivery, or repossess any unpaid items.5. Late or Non-Payment
In the event of late payment or non-payment, Season’s Cove reserves the right to:- Suspend ongoing work or withhold delivery of completed pieces until full payment is received;
- Apply a late payment fee and/or statutory interest at the rate permitted under Belgian law for overdue commercial or consumer debts; and
- Recover any reasonable costs, including legal fees and collection expenses, incurred in the enforcement of payment obligations.6. Refunds and Cancellations
Deposits paid for commissioned works are non-refundable, as they cover materials, preparation, and time invested in the creative process. Refunds for standard (non-commissioned) artworks or items will only be issued in accordance with Season’s Cove’s Refund and Return Policy and subject to applicable consumer protection laws.7. Invoices and Records
All payments must be accompanied by an invoice reference or identifying information to ensure accurate processing. Clients are encouraged to retain copies of invoices and proof of payment for their records. Upon request, Season’s Cove will issue digital or printed invoices in compliance with Belgian accounting and tax regulations.
1. General Policy
All sales made by Season’s Cove are considered final once a work has been delivered, unless otherwise stated in a written agreement or required by applicable law. Refunds or exchanges may be granted solely at the discretion of Season’s Cove and will be evaluated on a case-by-case basis, taking into account the nature of the work, its condition upon return, and the circumstances of the request.2. Non-Refundable Items and Services
Due to the highly individualized and artistic nature of our work, the following categories are non-refundable once production has commenced or delivery has occurred:- Commissioned or customized pieces, including artworks, sculptures, and taxidermy created to client specifications;
- Live or preserved specimen works, given their biological and perishable nature; and
- Consultation or design services, once completed or rendered in part.Refunds for these items will only be considered in exceptional cases, such as when the item is materially defective, damaged in transit, or not delivered in accordance with the written specifications agreed upon prior to purchase.3. Proof of Defect or Damage
In cases where a client believes a delivered work to be defective or damaged, Season’s Cove may request clear photographic and/or video evidence of the issue within a reasonable time following delivery (typically within 7 calendar days). Claims submitted without adequate supporting documentation may not be accepted. If the claim is validated, remedies may include repair, replacement, or a partial refund, at the sole discretion of Season’s Cove.4. Condition and Return of Items
If a refund or exchange is approved, the client may be required to return the item in its original condition and packaging, unless the item’s nature makes return impractical. Returned works must be shipped via a trackable and insured method, with all shipping costs borne by the client unless otherwise agreed in writing. Items damaged due to improper handling, packaging, or environmental exposure after delivery will not be eligible for refund.5. Cancelations
Standard (non-commissioned) purchases may be eligible for cancellation prior to shipment, provided written notice is received and acknowledged by Season’s Cove.Commissioned or customized works cannot be cancelled once materials have been procured or work has begun, as deposits cover labor, preparation, and material costs.Live specimen orders cannot be cancelled once the preparation, packaging, or shipping process has started.6. Review and Acknowledgement
Clients are encouraged to review all descriptions, specifications, and consultations carefully prior to purchase or commission, to ensure full understanding of the nature, dimensions, materials, and limitations of each piece. Confirmation of purchase or signing of a commission agreement constitutes the client’s acceptance of these terms.7. Legal Compliance
This Refund Policy operates in accordance with Belgian consumer protection laws and applicable EU regulations. Nothing in this clause limits or excludes any rights clients may have under mandatory consumer law, where applicable. However, clients commissioning customized or perishable works acknowledge that such items are typically exempt from the statutory right of withdrawal under EU Directive 2011/83/EU on Consumer Rights.
1. Right to Terminate or Suspend Services
Season’s Cove reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or terminate any service, commission, or client access to our platforms or communications if:- The client breaches or violates any provision of these Terms or any written agreement;
- The client engages in abusive, unlawful, or unethical conduct toward our team, artists, or other clients;
- Payment obligations are not met within the agreed timeframe; or
- Continued engagement is deemed impractical, unsafe, or damaging to Season’s Cove’s reputation, operations, or legal compliance.
In such cases, any amounts already paid by the client may be retained by Season’s Cove to cover costs, materials, or work performed up to the date of termination, unless otherwise required by law.2. Termination by the Client
Clients may cancel or terminate an ongoing commission or project by providing written notice to Season’s Cove. Upon receipt of such notice:- Deposits or initial payments made to secure a commission are non-refundable, as they cover preparatory costs and time invested;
- The client shall be responsible for payment of all work completed, materials acquired, or expenses incurred up to the date of termination; and
- Season’s Cove will provide a written summary of work completed and an invoice for any remaining balance, which must be paid within the stated payment period.
- Cancellation does not entitle the client to ownership of unfinished work, sketches, materials, or designs, unless expressly agreed in writing and paid for in full.3. Effect of Termination
Upon termination of services, all rights granted to the client under these Terms, including any usage licenses or permissions, shall immediately cease, except where otherwise specified by written agreement. Any outstanding obligations of payment, confidentiality, or respect for intellectual property shall survive termination.4. Discretionary Continuation or Reinstatement
Season’s Cove may, at its discretion, agree to reinstate a suspended service or resume a terminated commission, provided that all outstanding issues—such as payment, behavior, or contractual compliance—have been resolved to our satisfaction. Such reinstatement may require additional written agreement and revised terms or fees.5. No Waiver of Rights
The termination or suspension of services does not waive or limit Season’s Cove’s right to pursue any other remedies available under these Terms, contract law, or applicable Belgian legislation, including the right to recover damages or enforce payment.
Force Majeure
1. Definition
Season’s Cove shall not be held liable for any delay, failure to perform, or inability to deliver artworks, minerals, taxidermy pieces, or commissioned services resulting from events beyond its reasonable control (“Force Majeure Events”), including but not limited to:- Natural disasters (floods, storms, fires, earthquakes);
- Epidemics, pandemics, or other public health emergencies;
- Acts of government, regulatory changes, or legal restrictions;
- Transportation or supply chain disruptions, including delays or shortages of materials;
- Labor disputes, strikes, or workforce shortages;
- Power outages, technical failures, or other operational interruptions;
- Any other event reasonably beyond the control of Season’s Cove.2. Effect on Obligations
In the event of a Force Majeure Event:- Season’s Cove may suspend performance, delay delivery, or terminate the agreement without liability for any resulting loss or damage;
- Clients will be notified promptly of the occurrence of the Force Majeure Event and its expected impact on delivery timelines;
- Any deadlines, schedules, or delivery dates affected by such events shall be extended for a reasonable period, commensurate with the duration and impact of the event.3. Client Remedies
Clients may:- Accept a reasonable revised delivery schedule proposed by Season’s Cove; or
- Cancel the affected commission or order in writing, subject to payment for any work already completed, materials purchased, or expenses incurred prior to the Force Majeure Event. Deposits or partial payments covering unrecoverable costs may be retained, but Season’s Cove shall make reasonable efforts to minimize such costs where possible.4. Limitation of Liability
Season’s Cove shall not be liable for any indirect, incidental, or consequential damages, including loss of profit, opportunity, or reputation, arising from delays, interruptions, or failure to deliver caused by Force Majeure Events.5. Mitigation
Both Season’s Cove and the client shall use reasonable efforts to mitigate the effects of any Force Majeure Event, including cooperating on revised schedules, alternative arrangements, or adjustments to commissions where feasible.
You agree that no product, content, data, imagery, design, artwork, writing, or any other material (collectively, “Season’s Cove Materials”) obtained from, derived from, or otherwise associated with Season’s Cove may be used, in whole or in part, for the purpose of training, developing, improving, fine-tuning, or otherwise contributing to any artificial intelligence (“AI”), machine learning (“ML”), neural network, large language model (“LLM”), or other generative computational system or technology.Without limiting the foregoing, you are expressly prohibited from:- Uploading, inputting, or submitting any Season’s Cove Materials to any AI or ML system, platform, or service, whether public or private, open-source or proprietary.
- Using Season’s Cove Materials to generate or assist in generating synthetic content, including but not limited to text, imagery, video, audio, code, or datasets, through automated or algorithmic processes.
- Incorporating or referencing Season’s Cove Materials in the creation, enhancement, or evaluation of any AI model, dataset, or derivative system intended for public or commercial use.
- Permitting or authorizing any third party to engage in the foregoing activities.Any attempt to use Season’s Cove Materials in connection with AI or ML technologies, including indirect use through intermediaries, automated scraping, or dataset aggregation, constitutes a material breach of these Terms and may result in immediate termination of your access to Season’s Cove services and/or products, without refund, and may subject you to legal action for damages, injunctive relief, and/or other remedies available under applicable law.Season’s Cove reserves the right to employ technical measures, digital watermarking, and other forms of monitoring or enforcement to detect and prevent unauthorized AI-related use of its materials. By accessing or using any Season’s Cove Materials, you acknowledge and agree to these restrictions and affirm that you will take all reasonable steps to ensure compliance by your employees, contractors, and affiliates.
